The Family Medical Leave Act Undergoes Major Changes For The First Time
Nonprofit and Church Legal Trends - Free Edition - January February 2009 (free edition)
The Family Medical Leave Act, which has long been a source of controversy and confusion in the workplace, has undergone major changes for the first time in its 15-year history. The U.S. Department of Labor has published revised FMLA regulations, detailed in more than 750 pages, which explain how and when employees can take unpaid leave to care for a sick relative or themselves. The new rules, which took effect on Jan. 16, 2009, were a response to complaints by employers and employees alike. Employers have long argued that workers abuse the FMLA, especially in the area of intermittent leave. Employees counter that they are being unfairly denied family medical leave and are often retaliated against for taking it.
