A freelance photographer residing in Pennsylvania was injured in Salem, New Jersey when he slipped and fell walking down a ramp at the Delaware Valley Bluegrass Festival at the Salem County Cooperative Fair Association’s fair grounds which was organized by a New Jersey charity. The Bluegrass Festival was run by the Brandywine Valley Friends of Old Time Music, a Delaware charity organized to promote and preserve bluegrass and old time music. The photographer sued both organizations in federal court in New Jersey and the two defendants both moved to dismiss the complaint on the grounds of New Jersey’s charitable immunity rule. Charitable immunity did not apply – “swiss cheese” law?
