The Ninth Circuit Court of Appeals has held that concern about a claim under the Religious Land Use and Institutionalized Persons Act (RLUIPA) does not justify a City’s granting a zoning permit for a church in a settlement agreement without giving the neighbors the opportunity to be heard at a hearing required by the zoning code.
